And he?s going from baseball?s toughest division for pitchers to what might be its easiest in the NL Central. Burnett had a 6.22 ERA in AL East play last season. In 2010, it was 5.82.

Browne says it?s imperative that tenants understand their obligations and?honour their contracts, even in difficult economic conditions.

Conversely, landlords need to ensure they disclose all relevant information to tenants.

?And in this current economic climate, they need to engage with tenants if there are signs of distress.?

Brown says he?s also hearing a willingness from landlords to look at contractual terms.

The office started life in 2003, and typically sees 10% growth in complaints each year.

Its annual report, released in September last year, showed that retail leasing accounted for about 70% of the 1,553 matters it tackled through 2011.

Browne says the body has a mediation success rate of more than 80%. Under the Retail Leases Act, parties cannot go to VCAT without going to the Small Business Commissioner first.

The Unpredictability of Patent Litigation - Patent Law Blog (Patently-O)

In her article Predicting Patent Litigation, recently published in the Texas Law Review (and available here.), Professor Colleen Chien proposed a model for predicting which patents are most likely to be litigated based on a combination of intrinsic and acquired patent file characteristics.? The article has since spawned two short responses, one by Professor Lee Petherbridge of Loyola Los Angeles and the other by Professors Jay Kesan (Illinois), David Schwartz (Chicago-Kent), and Ted Sichelman (San Diego), both published by the Texas Law Review. Both acknowledge Chien's substantial contribution to the literature, but express caution about the extent to which it is possible to perform practically useful data-driven patent litigation prediction given the current state of knowledge.

In On Predicting Patent Litigation, Lee Petherbridge argues that data-driven patent litigation prediction presents difficult modeling problems, especially when models are constructed from the types of data identified in Predicting Patent Litigation.? He points out that models used to identify which patents are likely to be litigated need to be both specific and sensitive in order for them to be useful to innovators and their advisors. He also explains that models that rely on causal relationships between acquired patent characteristics (such as reexamination) and patent litigation can be adversely affected by problems such as omitted variable bias and simultaneity. These concerns, he argues, limit such models? predictive usefulness because they can suppress the specificity and sensitivity necessary to make models practically useful. Kesan et. al. also express reservations about Professor Chien's model in Paving the Path to Accurately Predicting Legal Outcomes, but do so from the angle of methodological concerns.? In particular, Kesan et. al. identify and discuss the merits and the limitations Chien's dataset and empirical methodology, also raising the endogeneity concerns discussed by Petherbridge.? Another Tibetan monk sets himself on fire in China (AP)

BEIJING ? A Tibetan monk set himself on fire in western China and was beaten by security forces as they put out the flames, a rights group said, marking the latest in a series of dramatic protests against China's handling of its vast Tibetan areas.

Lobsang Gyatso, a 19-year-old monk from the Kirti monastery in Sichuan province's Aba prefecture, set himself ablaze on Aba's main street Monday afternoon, the London-based International Campaign for Tibet said.

Security forces beat Gyatso while extinguishing the flames, then took him away, the group said in an online statement posted late Monday. It was not immediately clear whether he survived.

Two Tibetans who tried to help Gyatso were severely beaten by police, ICT's statement said.

Aba prefecture has been the scene of numerous protests over the past several years against the Chinese government. Most are led by monks who are fiercely loyal to Tibet's exiled Buddhist leader, the Dalai Lama, who fled the Himalayan region in 1959 amid an abortive uprising against Chinese rule and is reviled by Beijing.

According to ICT, 20 Tibetan monks, nuns and laypeople have set themselves on fire in China over the past year, with at least 13 dying from their injuries. The self-immolations have occurred with increasing frequency in recent weeks, and most have taken place in Sichuan's remote and mountainous Tibetan areas.

An official with the local Communist Party's propaganda department in Aba said he was unaware of the latest case. He referred media to China's official Xinhua News Agency or the Foreign Ministry for reports about self-immolations, saying that only they were authorized to release such news.

Like many Chinese bureaucrats, the official would give only his surname, Bai.

There was no immediate report from Xinhua confirming the case. A duty officer with the Foreign Ministry said she would look into it but had no immediate information to share.

Western reporters trying to visit that part of Sichuan have been turned away by security forces.

Activist groups say the self-immolations are a protest against China's policies and a call for the return of the Dalai Lama.

The Chinese government has condemned the self-immolations and says an upsurge in violence in Tibetan areas, including some deadly clashes between Tibetan protesters and security forces, are being instigated by forces outside the country wanting to separate Tibet from China.

China says Tibet has always been part of its territory, but many Tibetans say the region was virtually independent for centuries and that Beijing's control is draining Tibetan culture.

Another overseas rights group, Free Tibet, said in a statement late Monday that around 200 Tibetans protested in a public square in neighboring Qinghai province's Yushu prefecture on Saturday and were surrounded by security forces, with some protesters reportedly detained. A second protest followed on Sunday, and Free Tibet quoted locals it did not identify as saying the situation in the town was very tense.

U.S.-funded broadcaster Radio Free Asia said Tuesday that a 21-year-old Tibetan, Tashi Palden, was detained in Sichuan's Ganzi prefecture on Saturday after a poster appeared on the wall of a local police station warning that three Tibetans were preparing to self-immolate. It didn't say if Palden was suspected of putting up the poster. RFA said he was detained while shouting slogans in the town center calling for Tibetan independence.

The broadcaster cited local sources in Ganzi who spoke on condition of anonymity.

RFA also said an advocate of Tibetan songs and other traditional culture who worked as a civil servant in Tibet's Naqu prefecture was detained by police last week, citing a source inside Tibet who spoke on condition of anonymity. The broadcaster said Dawa Dorje was detained upon return to Tibet from Sichuan, where he urged a conference of singers to promote Tibetan language and culture through their music.

US weighing steep nuclear arms cuts

(AP) ? The Obama administration is weighing options for sharp new cuts to the U.S. nuclear force, including a reduction of up to 80 percent in the number of deployed weapons, The Associated Press has learned.

Even the most modest option now under consideration would be a historic and politically bold disarmament step in a presidential election year, although the plan is in line with President Barack Obama's 2009 pledge to pursue the elimination of nuclear weapons.

No final decision has been made, but the administration is considering at least three options for lower total numbers of deployed strategic nuclear weapons cutting to: 1,000 to 1,100; 700 to 800, and 300 to 400, according to a former government official and a congressional staffer. Both spoke on condition of anonymity in order to reveal internal administration deliberations.

The potential cuts would be from a current treaty limit of 1,550 deployed strategic warheads.

A level of 300 deployed strategic nuclear weapons would take the U.S. back to levels not seen since 1950 when the nation was ramping up production in an arms race with the Soviet Union. The U.S. numbers peaked at above 12,000 in the late 1980s and first dropped below 5,000 in 2003.

Obama often has talked of his desire to seek lower levels of nuclear weapons, but specific options for a further round of cuts had been kept under wraps until the AP learned of the three options now on the table.

A spokesman for the White House's National Security Council, Tommy Vietor, said Tuesday that the options developed by the Pentagon have not yet been presented to Obama.

The Pentagon's press secretary, George Little, declined to comment on specific force level options because they are classified. He said Obama had asked the Pentagon to develop several "alternative approaches" to nuclear deterrence.

The U.S. could make further weapons reductions on its own but is seen as more likely to propose a new round of arms negotiations with Russia, in which cuts in deployed weapons would be one element in a possible new treaty between the former Cold War adversaries.

Stephen Young, senior analyst at the Union of Concerned Scientists, which favors nuclear arms reductions, said Tuesday, "The administration is absolutely correct to look at deep cuts like this. The United States does not rely on nuclear weapons as a central part of our security."

Even small proposed cuts are likely to draw heavy criticism from Republicans who have argued that a smaller nuclear force would weaken the U.S. at a time when Russia, China and others are strengthening their nuclear capabilities. They also argue that shrinking the American arsenal would undermine the credibility of the nuclear "umbrella" that the United States provides for allies such as Japan, South Korea and Turkey, who might otherwise build their own nuclear forces.

The administration last year began considering a range of possible future reductions below the levels agreed in the New START treaty with Russia that took effect one year ago. Options are expected to be presented to Obama soon. The force levels he settles on will form the basis of a new strategic nuclear war plan to be produced by the Pentagon.

The U.S. already is on track to reduce to 1,550 deployed strategic nuclear warheads by 2018, as required by New START. As of last Sept. 1, the United States had 1,790 warheads and Russia had 1,566, according to treaty-mandated reports by each. The treaty does not bar either country from cutting below 1,550 on its own.

Those who favor additional cuts argue that nuclear weapons have no role in major security threats of the 21st century, such as terrorism. A 2010 nuclear policy review by the Pentagon said the U.S. nuclear arsenal also is "poorly suited" to deal with challenges posed by "unfriendly regimes seeking nuclear weapons," an apparent reference to Iran.

It is unclear what calculus went into each of the three options now under consideration at the White House.

The notion of a 300-weapon arsenal is featured prominently in a paper written for the Pentagon by a RAND National Defense Project Institute analyst last October, in the early stages of the administration's review of nuclear requirements. The author, Paul K. Davis, wrote that he was not advocating any particular course of action but sought to provide an analytic guide for how policymakers could think about the implications of various levels of nuclear reductions.

Davis wrote that an arsenal of 300 weapons might be considered adequate for deterrence purposes if that force level was part of a treaty with sound anti-cheating provisions; if the U.S. deployed additional non-nuclear weapons with global reach, and if the U.S. had "hypothetically excellent," if limited, defenses against long- and medium-range nuclear missiles.

In 2010, three Air Force analysts wrote in Strategic Studies Quarterly, an Air Force publication, that the U.S. could get by with as few as 311 deployed nuclear weapons, and that it did not matter whether Russia followed suit with its own cuts.

New U.S. cuts could open the prospect for a historic reshaping of the American nuclear arsenal, which for decades has stood on three legs: submarine-launched ballistic missiles, ground-based ballistic missiles and weapons launched from big bombers like the B-52 and the stealthy B-2. The traditional rationale for this "triad" of weaponry is that it is essential to surviving any nuclear exchange.

As recently as last month the administration said it was keeping the triad intact under current plans, while also hinting at future cuts to the force. In the 2013 defense budget submitted to Congress on Monday, the administration proposed a two-year delay in the development of a new generation of ballistic missile submarines that carry nuclear weapons. That would save an estimated $4.3 billion over five years.

In congressional testimony last November, the Pentagon's point man on nuclear policy, James N. Miller, would not say what options for force reductions the administration was considering. Republican Rep. Michael Turner, chairman of the House of Representatives' Armed Services Committee strategic forces subcommittee, unsuccessfully pressed Miller for key details about his policy review. As recently as last month Turner said in an interview that he feared the administration was bent on cutting the force.

In his written testimony at a Nov. 2 hearing chaired by Turner, Miller made it clear that the administration was making a fundamental reassessment of nuclear weapons requirements. In unusually stark terms he said the critical question at hand was "what to do" if a nuclear-armed state or nonstate entity could not be deterred from launching an attack.

"In effect, we are asking: what are the guiding concepts for employing nuclear weapons to deter adversaries of the United States, and what are the guiding concepts for ending a nuclear conflict on the best possible terms if one has started?" he said.

Nuclear stockpile numbers are closely guarded secrets in most states that possess them, but private nuclear policy experts say no countries other than the U.S. and Russia are thought to have more than 300. The Federation of American Scientists estimates that France has about 300, China about 240, Britain about 225, and Israel, India and Pakistan roughly 100 each.

Since taking office Obama has put heavy emphasis on reducing the role and number of nuclear weapons as part of a broader strategy for limiting the global spread of nuclear arms technology and containing the threat of nuclear terrorism. That strategy is being put to the test most urgently by Iran's suspected pursuit of a nuclear bomb.

Investigators seek answers to Houston's death (AP)

LOS ANGELES ? Whitney Houston's life of glorious song and unnerving self-destruction apparently ended in a bathtub at the Beverly Hilton Hotel on Grammy weekend, but it could be weeks before investigators know exactly why she died.

Coroner's officials say they will not release any information on an autopsy performed Sunday at the request of police detectives investigating the singer's death. Houston was found in the bathtub of her room, but Assistant Chief Coroner Ed Winter declined to say anything more about the room's condition or any evidence investigators recovered.

There were no indications of foul play and no obvious signs of trauma on Houston's body, but officials were not ruling out any causes of death until they have toxicology results, which will likely take weeks to obtain. Beverly Hills Police Lt. Mark Rosen said that his agency may release more details Monday about Houston's death, but it will depend on whether detectives feel comfortable releasing any information.

Security holds on autopsy results are used in some high-profile Los Angeles cases, with Michael Jackson's results being withheld for weeks while detectives pieced together the circumstances of his death in June 2009. Toxicology results are frequently necessary before the coroner will release an official cause of death.

A member of Houston's entourage found the 48-year-old singer unresponsive in her hotel room at the Beverly Hilton Hotel on Saturday, just hours before she was supposed to appear at a pre-Grammy gala.

Liquor

The worst part about consuming hard liquor is usually the mixers. When you make a rum and coke, cranberry vodka, etc. you?re drinking a lot of sugar with your alcohol. To cut back on some calories but still enjoy your drinks try buying a reduced sugar or sugar free mixer. Trop50 for example is a great fruit juice to buy and it tastes quite good. Club soda is the best mixer to use if you can handle the taste of your drink. Another little trick is to use more ice, thus filling up your cup more with water and reducing the amount of liquor. The last tip would be to use diet soda instead of regular. The diet has less sugar and the difference in taste is not that significant.

Condiments

Condiments may not make as big of an impact as other groups but changing a few choices can certainly help. For starters, if you?re using mayonnaise with any of your food why not buy low fat mayo? Sauces are much trickier but if you must have something on your food get some hot sauce. It will have a slight kick but the ingredients that hot sauce is composed of are totally healthy. You?ll be surprised to know how much corn oil and high fructose corn syrup is in other sauces. If there are salads available use fat free dressing, vinegar, olive oil or balsamic vinaigrette, instead of the dressings filled with fat.

Snacks

You?re going to have to put down the potato chips - yeah sorry. Wipe your fingers off too while you?re at it. Most chips are just an extension of fried food and not very good for you. Pretzels and Crackers are your new best friend in the snack world. If you can bring reduced fat anything, do it. Pretzels, crackers, Wheat Thins and Triscuits are all better alternatives. Another great one is any grilled vegetables (corn, potatoes).

Food

Fried food isn?t your friend if you?re looking to watch your figure.? When people actually read the nutrition contents of a burger they are pretty surprised at the fat content. If you still insist on hamburgers and don?t want to scare off your friends for being too healthy, look for reduced fat ground beef at the Supermarket. ?Want to add cheese to your healthier burger? Get low fat cheese. Grilled chicken is a great alternative and you can even coat it in several spices or hot sauces to make some spicy chicken.

Desserts

Desserts are supposed to be a sparingly ingested sweet. However, if you must find a craving for your sweet tooth and don?t want to have fruit then go ahead and have desert. Just have it in moderation! It?s a desert, not a meal. You can cut some calories and fat by using reduced fat or sugar free sauces, cookies, ice cream, etc.

What one has to realize is that by using some of these tips one will be able to have plenty of food and drink, without as much guilt to go with it. The bottom line is you can still have fun; the key is to make a few small changes that add up to a big difference. You can still drink some beer have some burgers and dessert. Don?t kill yourself over it, you?re at a tailgate and the point is to enjoy yourself. Hopefully these reminders will help lead to a slightly healthier tailgate for some from here on out. BEIJING (Reuters) ? China betrayed signs of spluttering domestic demand on Friday as imports crumbling to their lowest in more than two years and weaker-than-forecast bank lending signaled to investors that policymakers would soon make a fresh bid to bolster growth.

China's economic expansion struck a 2- year low of 8.9 percent in the last three months of 2011, extending a steady slowdown that had prompted the government in the autumn to switch policy settings to support growth. It has gently eased monetary and fiscal conditions since.

Now more is needed.

"I think that liquidity conditions are too restrictive. The economy is slowing down and liquidity conditions are restrictive," said Yao Wei, China economist at Societe Generale in Hong Kong.

A fall of 15.3 percent in imports in January compared with January 2011 was the lowest reading since August 2009, while exports fell 0.5 percent over the same period, the worst showing since November 2009, customs data showed on Friday.

That was followed by data from the People's Bank of China showing that new lending was less than 75 percent of the level expected -- a big surprise for a financial system that typically sees its biggest lending splurge of the year in January.

"That supports our view that there should be more RRR cuts," said Kevin Lai, an economist at Daiwa in Hong Kong, referring to the bank reserve requirement ratio. A cut in reserves would release cash into the economy.

"We expect there should be four this year, so we expect the next one very soon," Lai said.

The combination of data points raises numerous worries even though Lunar New Year holidays fell in January, which can make it difficult to interpret economic figures.

First, that the domestic demand which has shielded the world's second-largest economy from slackening exports is not as resilient as thought. Second, that China's ability to support a frail global economy by absorbing more imports is undermined.

And third, that weaker-than-expected lending is a function of banks being at their limit of credit creation, meaning the central bank will need to expand the range of policy tools beyond cuts in the reserve requirement ratio and use of open market operations if it is to effectively boost the supply of credit.

"The trade data, especially imports, show that domestic demand is slowing quite rapidly. But the lending data is more indicative of that right now, the capacity to ease liquidity conditions is not as great as people thought," said Yao.

"Right now the binding constraint is not the required reserve ratio, but the loan-to-deposit ratio."

Lunar New Year distortions will make policymakers wary of any hasty reaction. Most analysts expect them to assess January and February data combined before deciding whether the current policy of gentle easing should be intensified.

The week-long Lunar New Year holiday, which fell in January this year and in February last year, typically sees factories shut or run at half speed during the period.

But seasonal factors alone do not convince every economist that January is a one-off distortion, especially for trade.

"A fall of over 15 percent in January cannot be entirely explained by the Lunar calendar, and adds weight to the view that economic output is slower than headline indicators might suggest," said Ren Xianfeng, an economist at IHS Global in Beijing.

Exports to the European Union, China's top export market, fell 3.2 percent in January from a year earlier, the first decline since February last year, the data shows.

Exports to the United States rose 5.5 percent in January from a year earlier, slowing from December's 11.9 percent rise and marking the weakest pace since February last year.

The big imports drop combined with a smaller exports drop left China with a trade surplus of $27.3 billion in January, its biggest in six months and confounding expectations of a further narrowing.

Realisation that January would produce a bigger trade surplus may well have held the central bank back from reducing the RRR that month, when many economists had expected a cut.

It cut bank reserves by 50 basis points to 21 percent on Dec 5, a move economists believe was a response to rare capital outflows from China in the fourth quarter of 2011.

China's monetary policy essentially targets a level of overall money supply which is affected by external capital flows and internal credit creation.

So broad M2 money supply growth of 12.4 percent in January -- the slackest pace of expansion since May 2001 -- has reignited expectations that the central bank will seek to boost credit before long.

"The weak data may reflect the softening lending demand from the real economy, which is slowing down on slackening demand at both home and abroad," said Jiang Chao, analyst at Guotai Junan Securities in Shanghai.

"But we cannot ignore the uncertainties stemming from the Chinese New Year effect and should better wait for the February data to call it a trend."

EXTERNAL UNCERTAINTY

Other figures on Friday showed China's current account surplus shrank in 2011, offering Beijing fresh evidence to show critics of its currency policy that it is relying less on external demand.

Chinese leaders can point to the figures next week at a summit with European Union officials in Beijing, as can Vice-President Xi Jinping, widely expected to be China's next leader, who visits Washington on Tuesday.

Xi is likely to hear calls in the United States next week that Beijing allow the currency to rise at a faster rate. The EU is also likely to make such calls when it meets China's leaders.

However, a Reuters poll this month suggested such hopes may be dashed. It showed that China is expected to slow the pace of yuan gains to help exporters cope with the slowdown in global demand growth.

China's economic growth slowed steadily throughout 2011. But the slope of the slowdown was shallow enough for the consensus to emerge that a hard economic landing will be avoided, even though many private-sector economists forecast that 2012 will see the slowest pace of expansion in a decade.

The first quarter of 2012 is widely expected to mark the bottom of China's economic downswing. Signs from the most recent purchasing managers index survey showed a slight expansion of the factory sector in January.

And analysts are wary about forecasting a cut in the RRR too soon, since data on Thursday showed annual inflation spiked to a consensus-busting 4.5 percent in January.

"Taken at face value, today's trade data should push policy makers to loosen policy further. This may well happen if February year-on-year exports data is still as low but we believe there will be a large rebound to double-digit levels," Yu Song, China economist at Goldman Sachs, said in a note to clients.

Zheng Yuesheng, statistics chief with the customs administration, told state radio such a rebound was likely.

"Exports and imports in February, before seasonal adjustment, will see a sharp rise," Zheng was quoted as saying.

Killer whales denied anti-slavery protection

A federal judge on Wednesday dismissed a lawsuit that sought to give killer whales at SeaWorld constitutional rights.

The animal rights group People for the Ethical Treatment of Animals (PETA) sued SeaWorld Inc.?in San Diego on Oct. 6, 2011, for allegedly violating the anti-slavery 13th Amendment rights of orca whales.


Monday, U.S. District Judge Jeffrey Miller heard the case. Miller was the first judge to ever hear arguments over animals' constitutional rights.

Miller did not immediately dismiss the case. Instead, he took it under submission Monday after about an hour of questioning.

"As 'slavery' and 'involuntary servitude' are uniquely human activities, as those terms have been historically and contemporaneously applied, there is simply no basis to construe the Thirteenth Amendment as applying to non-humans," Miller stated in his ruling.

SeaWorld filed a motion to have case dismissed even before the hearing.

"Today?s decision does not change the fact that the orcas who once lived naturally wild and free are today kept as slaves by SeaWorld," a PETA spokesperson stated Wednesday after the ruling. "PETA will regroup and determine how to continue to work for the legal protection they deserve."

In the courthouse Monday, an attorney representing SeaWorld said that PETA's arguments had "no place in a federal courtroom." He added that, regardless of whether animals were being abused, this was not a matter of constitutionality. If PETA were truly concerned about the well-being of the whales, they would file an Animal Welfare Act lawsuit, he said.

"Orcas ... are not human beings. And I?need not remind the court that African-Americans are,"?the attorney said, drawing on the intention of the 13th Amendment to abolish the slavery of humans.

The official complaint filed in October in the U.S. District Court for Southern California lists five SeaWorld orcas?as collective plaintiffs in the case. Three of those killer whales live in the San Diego SeaWorld park. The other two live in the Orlando location.?

"They were ripped from their homes and families with whom they would have spent their entire lives," said Kerr. "They're denied everything natural to them. They're confined in the equivalent of concrete bathtubs."

PETA alleges that the two SeaWorld locations restrained and kept the whales in ?constant involuntary physical confinement,? with no means to escape. The complaint also accuses SeaWorld of depriving the killer whales of ?their ability to live in a manner of their choosing? and for ?intentionally subjugating? the killer whales? ?wills, desires, and/or natural drives and needs of [SeaWorld?s] own will and whims.?

In response, SeaWorld said the killer whales have no constitutional standing, and the lawsuit is a waste of the court's time.

"PETA has once again showed that it prefers publicity stunts to the hard work of caring for, rescuing and helping animals," SeaWorld's spokesperson said in October.
