Understanding When Pedestrians Can and Can't Sue a Motorist for ...

Walking is a great form of exercise and can be a good mode of transportation, but it can also put you at risk of being struck by a car. Unmarked Crosswalks

Most people assume that crosswalks only exist where they are marked on the pavement. However, Georgia law says that there are legal crosswalks at all public intersections that have a sidewalk on at least one side of the street. This means that you can be legally crossing even in an unmarked crosswalk, and therefore entitled to sue a motorist for your injuries.

Jaywalking

?Jaywalking? is not a term that appears in Georgia statutes, but it is a commonly used term to describe crossing outside of a crosswalk. Jaywalking is in fact legal in many places, as long as you are not crossing between adjacent, signalized intersections. If you are injured while jaywalking, the legal theories of negligence and comparative negligence come into play. You may be able to sue the driver, but you will not be able to recover for your injuries if you were more at fault for your injuries than the driver who struck you.

Private Property

Drivers are required by law to stop when emerging from an alley, building, private road, or driveway before driving across a sidewalk into the road. If you are hit while on private property, you may be able to sue the motorist who was responsible for your injuries.
